Forbest Standard Terms and Conditions
- Wholesale and Retail.
Forbest Products Co.(“Forbest”) sells products for business use to resellers and end users with proper business identification, which is required from all customers prior to purchase. Forbest reserves the right to accept or reject any order.
Prices are listed without including freight, handling fees, taxes, and/or duties, and are subjected to correction or change without notice. Market sensitive commodity products will be priced according to current market conditions. Customer should contact the local Forbest branch (US and Canada Location) or check online at www.forbestusa.com for current pricing.
- Sales Tax
Customers are responsible for payment of all applicable state and local taxes, or for providing a valid sales tax exemption certificate.
Forbest accepts Paypal, Visa and MasterCard.All payment must be made in U.S. dollars if the items are shipped from U.S. branch and all payment must be made in Canadian dollars if the items are shipped from Canada branch.
Customer agrees to assume responsibility for, and customer hereby unconditionally guarantees payment of, as provided herein, all purchases made by customer, its subsidiaries and affiliates. Each of customer's subsidiaries and affiliates purchasing from Forbest will be jointly and severally liable for purchases with customer, and customer is also acting as agent for such subsidiaries and affiliates.
- Credit Balance
Customer agrees that any credit balance by Forbest will be applied to customer’s account within three (3) months of its issuance.
All product order cancellations must be approved by Forbest, and may be subject to restocking fees and other charges.
- Custom Product
Forbest may offer products manufactured or assembled to customers specifications (“Custom Products(s)”) according to customers' request. Within fifteen (15) days of receiving the custom product, the customer must report to Forbest in written form if they are not satisfied with the custom product. If there are not any feedbacks in written form after fifteen (15) days, Forbest regardsthat the customer is satisfied with the custom product. Forbest One-Year Limited Warranty terms do not cover theloss for the design shortcomings of the custom product.All Custom Products are sold on a “FINAL SALE” basis only, and no cancellations, returns, refunds or credits are allowed, except that the custom product has the major defects of manufacturing.
All orders, whether for parts or whole camera system are shipped F.O.B. Forbest Products Co. in California in us or Forbest Products Co.(Canada) in Ontario in Canada. Freight and transportation as well as freight and transportation insurance are the customer’s sole responsibility. Forbest will insure all shipments for the maximum invoice amount.
C.O.D. shipments are not permitted. Generally Forbest deliver products by UPS in US and by UPS or Canada Post in Canada. Other courier service is possible but extra charge may be needed. A physical street address is required for all addresses and PO Box is not acceptable for delivery. Adult signature is needed for the confirmation of the receipt of products. In case that the customer asks for changing the address after the order is shipped out, customer will pay for the cost of address change.
Basically Forbest deliver items to US customers from US branch and to Canada customers from Canada branch. In the event that there is no stock and customers need the product urgently, we may deliver items by international shipping. Import duties, taxes and brokerage charges are NOT INCLUDED in the item price or shipping charges. These charges are the buyer’s responsibility. These charges are normally collected by the delivering shipping company or when you pick the item up. Please do not confuse them for additional shipping charges.
- SATISFACTION GUARANTEE TO ALL CUSTOMERS: 30-DAY MONEY BACK POLICY
Customersshould contact Forbest if they are not satisfied with a product for any reason within 30 days of the invoice date. A 30-day Money Back is guaranteed (Shipping & Handling and other additional charges, such as the transaction fee 4% of the total amount charged by bank or Credit Card Company, are not refundable). However, Returned product must be in original packaging, unused, undamaged, and in saleable condition. Proof of purchase is required in all cases. The 30-Day Money Back Policy does not apply the custom product.
- LIMITED WARRANTY
All products sold are warranted by Forbest only to customers for: (i) resale; or (ii) use in business, government or original equipment manufacture. Forbest warrants products against defects in materials and workmanship under normal use for a period of ONE (1) year the date of purchase from Forbest, unless otherwise stated. Should the customer have any problem about the Forbest product, the customer should contact the dealer or Forbest immediately. Forbest will not cover the defective items in warranty term after the product has been repaired by a third party even if it is within 1 year since the purchased date.
During the limited warranty period, Forbest may, at its option: (i) repair; (ii) replace; or (iii) refund the amount paid by customer. Customer must return the product to the appropriate Forbest branch or authorized service location, as designated by Forbest and pay for the shipping cost. Forbest will cover the shipping cost for the return of the product to customers in 46 states of US and in Canada within the warranty term.For a RMA item from other offshore regions (Hawaii, Alaska, Puerto Rico, and the U.S. Virgin Islands) and countries outside of US and Canada, the customer has to pay all the shipping including the return shipping from Forbest and tax, if any, even for an item within the warranty term. In the event that there are import charges and brokerage charges in processing repair or replacement of warranted items, the incurred import charges and brokerage charges will be undertaken by the importer regardless of either party.
- Warranty Return
Before retuning any product, customer shall: (i) write or call the local Forbest branch from which the product was purchased; (ii) fill in the Forbest RMA form and provide the date, the original invoice number, the stock number, and the description of the defect (iii) or report to the dealers and ask them to contact us. Proof of purchase is required in all cases.
For those returned items exceeding over 6 months, Forbest will send an emal or call the customer after 6 months to remind the customer and the customer should get back to Forbest within 5 business days. Otherwise, Forbest has the right to dispose of the returned items at its own will without undertaking any cost or responsibility.
- Catalog/Website Information
Forbest reserves the right to correct publishing errors in its catalogs and advertisements or any of its websites. Product depictions in the catalog or websites are for illustrative purposes only. Possession of, or access to, any Forbest catalog, literature, advertisements or websites does not constitute the right to purchase products.
FORBEST RESERVES THE RIGHT TO CHANGE THE ABOVE STANDARD TERMS, CONDITIONS AND POLICES WITHOUT ANY NOTICE IN OUR ATTEMPTS TO BETTER SERVE OUR CUSTOMERS. UPDATES SHALL BE EFFECTIVE THE DATE THE CHANGE IS POSTED ON THE WEBSITE.
